12. Dispute Resolution

12.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate (collectively, "Dispute"), you agree to first attempt to resolve the Dispute informally by contacting us at [email protected]. We will attempt to resolve the Dispute informally by contacting you via email. If a Dispute is not resolved within thirty (30) days after either party submits notice of the Dispute to the other, either party may proceed to formal dispute resolution as described below.

12.2 Binding Arbitration

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THESE TERMS OR ANY ASPECT OF THE RELATIONSHIP BETWEEN YOU AND JET'S PIZZA SHALL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL ARBITRATOR, RATHER THAN IN A COURT BY A JUDGE OR JURY, IN ACCORDANCE WITH THE RULES OF THE AMERICAN ARBITRATION ASSOCIATION (AAA) CONSUMER ARBITRATION RULES. The arbitration shall be conducted in the English language. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

12.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, CLASS ARBITRATION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. Further, unless both you and Jet's Pizza agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not preside over any form of a class or representative proceeding.

12.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court in the applicable jurisdiction, provided the claim is eligible for small claims court and the relief sought is within the jurisdictional limits of such court.

12.5 Waiver of Jury Trial

BY AGREEING TO THESE TERMS, YOU ARE WAIVING YOUR RIGHT TO A TRIAL BY JURY TO THE EXTENT PERMITTED BY APPLICABLE LAW. All disputes that are not resolved through arbitration or small claims court shall be resolved by a judge sitting without a jury in a court of competent jurisdiction in the United States.

13. Term and Termination

These Terms shall remain in full force and effect for as long as you access or use the Website or maintain an account with us.
